INFORMACIÓN PRELIMINAR: No es necesario comprar. No es válido fuera del área geográfica terrestre de recepción de la señal de transmisión de KSTS-TV Telemundo 48 y donde esté prohibido. Este sorteo es válido únicamente para la participación de educadores de secundarias, trabajando en colegios de secundaria, dentro de los condados de Alameda, Contra Costa, Marin, Napa, San Francisco, San Mateo, Santa Clara, Solano, y Sonoma dentro del Estado de California (“Área de Elegibilidad”). Los educadores deberán ser maestros de secundaria, consejeros, y/o empleados directamente involucrados en impartir enseñanza a estudiantes de secundaria (“Educadores”) dentro del Área de Elegibilidad. El Sorteo Estudiar Es Triunfar (“Sorteo”) comienza el 15 de Septiembre de 2008 a las 12:00 A.M. y termina el 15 de Octubre de 2008 a las 5:00 P.M. (“Periodo del Sorteo”). Todas las horas en este Sorteo están indicadas en Horas del Pacífico. Las probabilidades de ganar dependen del número de inscripciones elegibles recibidas.

ELEGIBILIDAD: Abierto solamente para los residentes legales permanentes de los EE.UU. Para inscribirse en el Sorteo, el participante deberá ser Educador de un colegio de secundaria ubicado dentro del Área de Elegibilidad y tener por lo menos 18 años de edad a partir del comienzo de dicho Sorteo. Los Educadores pueden nombrar a cinco (5) estudiantes de secundaria que actualmente están en el doceavo grado, de cada clase que enseñan y/o aconsejan, como participantes en el Sorteo. Los funcionarios, directivos y empleados de las Entidades del Sorteo junto a sus familiares inmediatos (conyugues, padres y madres, hijos e hijas, y hermanos y hermanas y sus conyugues) y/o toda otra persona residiendo en el mismo lugar con estos (sean o no parte de la familia) no son elegibles para inscribirse en el Sorteo. Las Entidades del Sorteo, tal y como se las menciona aquí, incluirán a los Patrocinadores, y a sus respectivas casas matrices, empresas subsidiarias y afiliadas y agencias de publicidad y promoción y cualquier otra entidad que esté participando en el desarrollo, administración, promoción o implementación del Sorteo.

PARA INSCRIBIRSE: Para inscribirse, los Educadores deberán visitar al sitio Web de KSTS-TV Telemundo 48 a la siguiente dirección: www.Telemundo48.com haciéndole clic al icono de Estudiar es Triunfar. Baje y complete el formulario de inscripción, el cual requiere la siguiente información: el nombre del Educador, clase, nombre del colegio, dirección del colegio (incluyendo ciudad y código postal), dirección de correo electrónico (email), numero telefónico, numero de fax (si hubiere), y el nombre de cinco (5) estudiantes que actualmente se encuentren en el doceavo grado. En el formulario de inscripción, debe de hacerle clic o marcar la caja que está situada cerca del asterisco para verificar que la información proporcionada es verdadera y exacta y cumple con los requisitos de elegibilidad de este Sorteo. Después de cumplir lo anterior, someta el formulario de inscripción mediante una de las tres formas siguientes: (1) vía correo electrónico (email); (2) vía fax; o (3) por correo.

(3) Para someter su formulario de inscripción por correo, envíe por correo dicho formulario en un sobre cerrado con su respectivo sello postal, a la siguiente dirección: Estudiar Es Triunfar, attn: Carmen Valencia, Telemundo 48, 2450 N. First Street, San José, California 95131.

Las Inscripciones deberán ser recibidas antes de las 5:00 P.M. del 15 de Octubre de 2008 para ser elegibles al Sorteo. Cada Educador puede someter un formulario de inscripción por cada clase que imparte durante el Periodo de este Sorteo. Las Inscripciones múltiples recibidas de un mismo Educador o proveniente de una misma dirección de correo electrónico, para la misma clase, sobrepasando el límite de Inscripciones aquí establecido, anularán todas las Inscripciones adicionales. Las Inscripciones generadas por subrutinas de software, macros u otros medios automatizados serán descalificadas. Las Inscripciones que por cualquier motivo estén incompletas, confusas, alteradas o ininteligibles, incluyendo pero no limitado a fallas de computadoras o congestión de redes, quedarán anuladas y no serán aceptadas. En caso de controversia sobre la identidad de un participante que haya presentado una Inscripción potencialmente ganadora, los Patrocinadores se reservan el derecho a considerar que la Inscripción ha sido hecha por el titular autorizado de la cuenta de correo electrónico usada en el momento de la inscripción. La Inscripción constituye autorización (excepto donde lo prohíba la ley) para usar su/s nombre/s y apellido/s, ciudad, estado, semejanza, imagen y/o voz en campañas de publicidad, promociones, e iniciativas de relaciones públicas, sin compensación adicional.

SELECCIÓN DEL GANADOR Y NOTIFICACIÓN: Los empleados de los Patrocinadoras, seleccionarán al azar, de todas las Inscripciones elegibles, a cuatro (4) Inscripciones ganadoras en un sorteo que se llevará a cabo aproximadamente el 16 de Octubre de 2008. Los veinte (20) estudiantes y cuatro (4) Educadores, cuyos nombres se encuentren en la lista de Inscripciones ganadoras, serán los ganadores del primer premio (“Ganadores del Primer Premio”). Aproximadamente el 24 de Noviembre de 2008, los empleados de los Patrocinadores seleccionaran al azar a un estudiante entre los Ganadores del Primer Premio quien será el ganador de la beca (“Ganador de la Beca”). Los Patrocinadores harán dos (2) intentos de notificar al Ganador/es al número de teléfono y/o dirección de correo electrónico presentado al momento de la inscripción. A los Ganadores del Primer Premio y al Ganador de la Beca (“Ganador(es)”) (o, si el Ganador fuese un menor de edad, a uno de sus padres o su tutor legal), se le podrá exigir que firme y devuelva una declaración jurada de elegibilidad, un relevo de responsabilidad y, excepto donde esté prohibido, un relevo de publicidad completados, firmados y notariados (conjuntamente “Documentos del Sorteo”) dentro de los tres (3) días de tal notificación. El incumplimiento de este requisito en el periodo de tiempo indicado resultará en la descalificación y se seleccionará un Ganador alterno para la entrega del premio. Si no se puede ubicar al Ganador, si se determina que no es elegible o no cumple o no puede cumplir con estas Reglas Oficiales, o si se devuelve el premio o la notificación del premio por ser imposible de entregar, se descalificará a dicho Ganador eventual y se podrá seleccionar en su reemplazo a otro Ganador eventual entre las Inscripciones elegibles restantes. Limitado a un (1) premio por familia o residencia.

PREMIO: Se otorgará un total de veinticinco (25) premios (“Premios”), consistiendo de veinte (20) primer premios para estudiantes (“Primer Premios para Estudiantes”), cuatro (4) primer premios para Educadores (“Primer Premios para Educadores”), y un (1) Premio de Beca para un (1) estudiante (“Premio de Beca”). Cada Primer Premio para Estudiante consiste de lo siguiente: una gira por la estación de televisión KSTS, una entrevista grabada que, a discreción de los Patrocinadores podría ser transmitida por KSTS, una mochila conteniendo artículos escolares (incluyendo, pero no limitándose a, cuadernos, plumas y/o lápices), y el estudiante participará en un sorteo para la oportunidad ganarse la beca académica. Cada Primer Premio para Educadores consiste de una gira por la estación de televisión KSTS y una entrevista grabada que podría ser transmitida por KSTS a la discreción de los Patrocinadores. El Premio de Beca consiste de una beca académica valorada en dos mil ($2,000) dólares. El Valor Minorista Estimado (“ERV” por sus siglas en inglés) del Primer Premio para Estudiantes es de cincuenta ($50) dólares. El ERV total de los Primer Premios para Estudiantes es de mil ($1,000) dólares. No existe ERV para los Primer Premios para Educadores porque la gira por la estación de televisión KSTS no tiene equivalencia en valor monetario. El ERV del Premio de Beca es de dos mil ($2,000) dólares. El ERV de todos los Premios es de tres mil ($3,000) dólares. Los Patrocinadores proveerán al Ganador un formulario 1099 del Servicio Interno de Rentas (“IRS” por sus siglas en inglés) por el ERV del Premio en el año fiscal en que el Premio haya sido ganado.
Telemundo 48 no proporcionará transporte alguno a/de la estación de televisión KSTS. Los detalles específicos de los Premios serán determinados a la discreción exclusiva de los Patrocinadores. Los Patrocinadores se reservan el derecho de sustituir el Premio con otro similar (o partes del Premio) de igual o mayor valor. Los impuestos y demás gastos, costos o cargos relacionados con la aceptación y/o uso del Premio son responsabilidad exclusiva del Ganador. El Premio no puede ser transferido por el Ganador ni canjeado por dinero en efectivo, y es válido solamente por los servicios detallados más arriba sin que se permitan sustituciones de Premio por parte del Ganador. Si un Premio no es reclamado, será perdido y los Patrocinadores seleccionarán al azar a un nuevo Ganador sustituto de entre las demás Inscripciones elegibles. Si alguna parte del Premio no estuviera disponible por cualquier motivo, las demás partes del Premio constituirán cumplimiento pleno de la responsabilidad de los Patrocinadores hacia el Ganador con relación al Premio y no se adjudicará ninguna compensación adicional. Los Premios ganados por menores de edad serán otorgados a nombre de uno de sus padres o tutor legal.

La visita a a la estación de televisión (“Visita a la Estación”) no tiene valor monetario. Si la Visita a la Estación se cancela antes, o es diferido durante la Presentación, las partes restantes del Premio constituirán pleno cumplimiento de la obligación de los Patrocinadores hacia el Ganador con relación al Premio y no se adjudicará ninguna compensación adicional. Si el Ganador no se presenta cuando se le indique para la Visita a la Estación, tal y como lo dispongan los Patrocinadores a su exclusiva discreción, la Visita a la Estación podrá ser cancelada y el Premio perdido. Ninguna persona ajena podrá estar presente, con excepción del Ganador y demás personas autorizadas por los Patrocinadores, en la Visita a la Estación. Los Patrocinadores decidirán a su exclusiva discreción la naturaleza de la Visita a la Estación y no tendrán obligación alguna de hacer que el Ganador se presente, de transmitir, o de todo otro modo usar o explotar el Programa o cualquier parte del mismo.

Si los Patrocinadores deciden, a su exclusiva discreción, incorporar Grabaciones de audio y video a la Visita a la Estación y/o entrevistas (“Grabación”), la Grabación no será considerada oportunidad de empleo y el Ganador no tendrá derecho a ninguna compensación o crédito por las mismas. Los Patrocinadores decidirán a su exclusiva discreción la naturaleza de la Grabación. Si la Grabación es transmitida, tal transmisión será realizada en un momento, con una duración y en una fecha decidida por los Patrocinadores a su exclusiva discreción. Se exigirá al Ganador que firme y devuelva relevos de presentación y lugar de grabación y demás documentos que los Patrocinadores puedan considerar pertinentes (“Documentos de Presentación”). En caso que el Ganador no cumpla con este requisito de firmar y devolver los Documentos de Presentación cuando se lo indiquen los Patrocinadores, a su exclusiva discreción, la Grabación podrá ser cancelada y el Premio perdido. El contenido de la Grabación, tal como y si se llega a transmitir, y el número de transmisiones y re-transmisiones de la misma, de haberlas, serán decididos por los Patrocinadores a su exclusiva discreción. El Ganador no tendrá derechos de revisión, notificación o aprobación del contenido de la Grabación o de las transmisiones de la misma. Los Patrocinadores se reservan el derecho a descalificar al Ganador y a eliminarlo del programa si en cualquier momento su conducta es considerada perjudicial, o si pudiera causar o causara algún daño a otra persona, a la propiedad, a la reputación de los Patrocinadores, si de todo otro modo viola las políticas relacionadas o si no respeta en todo momento las instrucciones de los Patrocinadores. Estas Reglas Oficiales y el Sorteo no constituyen un contrato ni una oferta/solicitud de empleo.

CONDICIONES: Inscribiéndose en este Sorteo, los participantes acuerdan, en nombre propio y a nombre y en representación de sus herederos, albaceas y administradores: (a) eximir y amparar a las Entidades del Sorteo y a sus respectivos funcionarios, directivos y empleados, (conjuntamente las “Partes Relevadas”) contra toda responsabilidad, enfermedad, lesión, muerte, pérdida, pleito, o daños y perjuicios que pudieran suceder, directa o indirectamente, causados por negligencia o por cualquier otro motivo resultando de su participación en este Sorteo y/o de su aceptación, o uso debido o indebido del Premio o cualquier parte del Premio; (b) indemnizar a las Partes Relevadas contra toda responsabilidad resultando o surgiendo del Sorteo y por este medio reconocer que las Partes Relevadas no han de ningún modo hecho, ni son responsables por extender, garantías o declaraciones expresas o implícitas, de hecho o en ley, relativas al Premio, incluyendo cualquier garantía expresa extendida exclusivamente por el proveedor mediante su entrega del Premio; (c) de ser seleccionado Ganador, a la publicación de su nombre/s y apellido/s, de ser Ganador, en www.telemundo48.com a que las Partes Relevadas usen su/s nombre/s y apellido/s, voz, imagen y/o semejanza en publicidad, promociones y campañas publicitarias sin compensación adicional y, de ser requerido, a dar su autorización, por escrito, para ese uso; y (d) a cumplir con estas Reglas Oficiales y a renunciar al derecho a reclamos por ambigüedad o error en estas Reglas Oficiales o en el Sorteo y a someterse a las decisiones de los jurados y/o Patrocinadores, las cuales son de carácter vinculante y final. El incumplimiento de cualquier término de estas Reglas Oficiales podrá resultar en la descalificación de este Sorteo.

CONDICIONES ADICIONALES: Los Patrocinadores se reservan el derecho a descalificar permanentemente de cualquier promoción a cualquier persona que estos crean haya violado deliberadamente estas Reglas Oficiales. Cualquier intento deliberado por dañar el Sorteo o su operación, es ilícito y está sujeto a acción legal por parte de los Patrocinadores, quienes podrán procurar reparación por daños y perjuicios en la medida máxima permitida por ley. El incumplimiento de cualquier cláusula de estas Reglas Oficiales por parte de los Patrocinadores debido a un caso fortuito, huracán, guerra, incendio, disturbio social, terremoto, amenaza o actividad terrorista, maniobra de enemigos públicos, decisiones de autoridades gubernamentales fuera del control de los Patrocinadores (excepto cumplimiento de normas y regulaciones vigentes) y todo otro hecho de fuerza mayor, no serán considerados violaciones de estas Reglas Oficiales. Las Partes Relevadas no asumen ningún tipo de responsabilidad por perjuicio o daño a la computadora del participante o de terceros, relacionados con o resultando de la Inscripción o de bajar materiales o software del Internet para participar en el Sorteo. Las Partes Relevadas no son responsables por fallas de ningún tipo en las telecomunicaciones o redes, fallas electrónicas, técnicas o de computadora, trascripción errónea de información de Inscripción, error en material promocional o de mercadeo, error en estas Reglas Oficiales, o cualquier error humano o electrónico en la administración de este Sorteo o este Premio, o por Inscripciones que sean robadas, mal dirigidas, alteradas o devueltas. Los Patrocinadores se reservan el derecho a cancelar, modificar o suspender el Sorteo o cualquier parte del mismo (incluyendo sin limitaciones estas Reglas Oficiales) sin ningún tipo de notificación y con cualquier motivo (incluyendo sin limitaciones en caso de alguna situación inesperada no contemplada en estas Reglas Oficiales). En caso de cancelación, modificación, o suspensión, los Patrocinadores se reservan el derecho a seleccionar Ganadores mediante un Sorteo al azar de entre todas las inscripciones elegibles que no estén bajo sospecha y hayan sido recibidas hasta el momento de que se haya producido la situación que requiere dicha cancelación, modificación, o suspensión. El aviso de dicha cancelación, modificación, o suspensión será publicada en www.telemundo48.com. Los Patrocinadores podrán prohibir la participación en este Sorteo, si el participante, o participante en potencia: demuestra indiferencia o no respeta estas Reglas Oficiales; exhibe una conducta desplegada para molestar, abusar, amenazar o acosar a otro participante, a los Patrocinadores, agentes o representantes de los Patrocinadores, o si se comporta de manera perjudicial (tal y como lo interpreten los Patrocinadores a su exclusiva discreción)..

September 15, 2008 - October 15, 2008

PRELIMINARY INFORMATION: No purchase necessary. Void outside the KSTS-TV Telemundo 48 terrestrial geographic viewing area and where prohibited. Open only to high school educators working at high schools within the counties of Alameda County, Contra Costa County, Marin County, Napa County, San Francisco County, San Mateo County, Santa Clara County, Solano County, Sonoma County in the State of California (“Eligibility Area”). Educators must be high school teachers, counselors, and/or school employees directly involved in providing education to high school students (“Educators”) within the Eligibility Area. Estudiar es Triunfar Sweepstakes (“Sweepstakes”) begins on September 15, 2008 at 12:00 A.M. and ends on October 15, 2008 at 5:00 P.M. (“Sweepstakes Period”). All times in the Sweepstakes refer to Pacific Time. Odds of winning depend upon the number of eligible entries received.

Eligibility: Open only to permanent, legal U.S. residents. To submit an entry, the entrant must be an Educator at a high school within the Eligibility Area and be at least 18 years of age as of the Sweepstakes Period. Educators may nominate five (5) high school students currently in the twelfth grade from each class they teach and/or counsel as participants in the Sweepstakes. Officers, directors, and employees of Sweepstakes Entities, members of these persons’ immediate families (spouses and/or parents, children, and siblings, and their spouses), and/or persons living in the same households as these persons (whether or not related thereto) are not eligible to enter the Sweepstakes. Sweepstakes Entities, as referenced herein, shall include Sponsors, and their respective parent, subsidiary, and affiliate companies and administrative, advertising, and promotion agencies and any other entity involved in the development, administration, promotion, or implementation of the Sweepstakes.

TO ENTER: To enter, Educators must access the KSTS-TV Telemundo 48 website at www.Telemundo48.com and click on the Estudiar es Triunfar icon. Download and complete the entry form, which requires the Educator’s name, class, school’s name, school’s address (including city and zip code), email address, phone number, fax number (if any), and the name of five (5) students who are currently in the twelfth grade. On the entry form, click or check on the box that is located near the asterisk in order to verify that the information provided is true and accurate and complies with the eligibility requirements of this Sweepstakes. Thereafter, submit the entry form in one of the following three (3) ways: (1) by email; (2) by fax; or (3) by mail.

Entries must be received before 5:00 P.M. on October 15, 2008 to be eligible for the Sweepstakes. Each Educator may enter one entry form per class during the Sweepstakes Period. Multiple Entries for the same class received from the Educator or email address beyond this limit will void all such additional Entries. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant who made a potentially winning entry, Sponsors reserve the right to deem that the entry was made by the registered subscriber of the email address submitted at the time of entry. Entry constitutes permission (except where prohibited by law) to use entrant's name, city, state, likeness, image, and/or voice for purposes of advertising, promotion, and publicity without additional compensation.

WINNER SELECTION AND NOTIFICATION: On or about October 16, 2008, the employees of Sponsors will select four (4) winning Entries in a random drawing from all eligible Entries. The twenty (20) students and four (4) Educators whose names are listed on the winning Entries will be the first prize winners (“First Prize Winners”). On or about November 24, 2008, the employees of Sponsors will select in a random drawing one student from the First Prize Winners to be the scholarship winner (“Scholarship Winner”). Sponsors will make two (2) attempts to notify the Educator at the phone number and/or email address submitted at the time of entry. First Prize Winners and Scholarship Winner (“Winner(s)”) (or, if Winner is a minor, his/her parent or legal guardian) may be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release Sweepstakes within three (3) days of such notification. Noncompliance within this time period will result in disqualification, and an alternate winner may be selected from the remaining eligible entries. If Winner cannot be reached, if he/she is found to ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification is returned as undeliverable, Winner will be disqualified and an alternate winner may be selected from the remaining eligible entries.

PRIZE: There will be a total of twenty-five (25) prizes (“Prizes”), consisting of twenty (20) student first prizes (“Student First Prizes”), four (4) educator first prizes (“Educator First Prizes”), and one (1) student scholarship prize (“Scholarship Prize”). Each Student First Prize consists of the following: a tour of the KSTS television station, a recorded interview that could be broadcast on KSTS in Sponsors’ sole discretion, a backpack with school supplies (including, but not limited to, a notebook, pens and/or pencils), and student will be entered as a participant in a random drawing for the opportunity to win a scholarship. Each Educator First Prize consists of a tour of the KSTS television station and a recorded interview that could be broadcast on KSTS in Sponsors’ sole discretion. The Scholarship Prize consists of a two thousand ($2,000) dollar scholarship. The Estimated Retail Value (“ERV”) of the Student First Prize is fifty ($50) dollars. The total ERV of Student First Prizes is one thousand ($1,000) dollars. There is no ERV of the Educator First Prize because a tour of the KSTS television station and interviews have no cash equivalent value. The ERV of the Scholarship Prize is two thousand dollars ($2,000). The ERV of all Prizes is three thousand ($3,000) dollars. Sponsors will furnish an Internal Revenue Service Form 1099 to Winner for the ERV of Prize for the tax year in which Prize was won.
Telemundo 48 will not provide transportation to and from the KSTS television station. Specifics of Prize will be determined by Sponsors in their sole discretion. Sponsors reserve the right to substitute a similar Prize (or Prize element) of equal or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for the items detailed above, with no substitution of Prize by Winner. If Prize is unclaimed, it will be forfeited, and an alternate Winner may be selected from the remaining eligible Entries. If a Prize element is not available for any reason, the remaining elements of Prize shall constitute full satisfaction of Sponsors' Prize obligation to Winner, and no additional compensation will be awarded. Prizes won by minors will be awarded in the name of their parent or legal guardian.

Station visit (“Station Visit”) has no cash equivalent value. If the Station Visit is cancelled prior to or pre-empted, the remaining elements of Prize shall constitute full satisfaction of Sponsors’ Prize obligation to Winner and no additional compensation will be awarded. If Winner fails to appear in a timely manner for the Station Visit, as determined by Sponsors in their sole discretion, the Station Visit may be cancelled and Prize may be forfeited. No person other than Winner and persons deemed necessary by Sponsors may be present at the Station Visit. The nature of the Station Visit will be determined by the Sponsors in their sole discretion. Sponsors are not obligated to have the Winner visit the KSTS station or to broadcast or otherwise use or exploit the Show or any part thereof.

If Sponsors, in their sole discretion, elect to incorporate the audio and video recording of the Station Visit and/or interviews (“Recording”), the Recording will not be considered an employment opportunity, and Winner will not be entitled to compensation or credit therefore. The nature of the Recording will be determined by Sponsors in their sole discretion. If the Recording is broadcast, such broadcast will be at a time, for a length of time, and on a date determined by Sponsors in their sole discretion. Winner will be required to execute and return appearance and location releases and such other documents as may be required by Sponsors (“Appearance Documents”). If Winner fails to execute and return Appearance Documents in a timely manner, as determined by Sponsors in their sole discretion, Recording may be cancelled and Prize may be forfeited. The content of the Recording as, and if, finally broadcast, and the number of broadcasts and re-broadcasts thereof, if any, will be determined by Sponsors in their sole discretion. Winner will have no right of review, notice, or approval of the content of the Recording or any broadcast thereof. Sponsors reserve the right to disqualify Winner and remove him/her from the Recording and/or broadcast at any time, if his/her behavior at any point is deemed by Sponsors to be disruptive, if it may or does cause damage to person, property, or reputation of Sponsors or otherwise violates the policies thereof, or if Winner does not follow the directions of Sponsors at all times. These Official Rules and the Sweepstakes are neither a contract nor an application for employment.

CONDITIONS: By entering the Sweepstakes, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release and hold harmless Sweepstakes Entities and their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof; (b) to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by Prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such entrant’s name on www.telemundo48.com and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes without additional compensation, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Sweepstakes itself, and to be bound by all decisions of the Sponsors, which are binding and final. Failure to comply with these conditions may result in disqualification from the Sweepstakes.

ADDITIONAL TERMS: Sponsors reserve the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Sweepstakes or the operation thereof is unlawful and subject to legal action by Sponsors, who may seek damages to the fullest extent permitted by law. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software in connection with the Sweepstakes. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsors reserve the right to cancel, modify, or suspend the Sweepstakes or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsors reserve the right to select Winners in a random drawing from among all eligible, non-suspect entries received at the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted at www.telemundo48.com. Sponsors may prohibit any entrant or potential entrant from participating in the Sweepstakes, if such entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsors, or Sponsors’ agents or representatives; or behaves in any other disruptive manner (as determined by Sponsors in their sole discretion).

DISPUTES: THE SWEEPSTAKES IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF FLORIDA, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN MIAMI, FLORIDA. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN FLORIDA. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF MIAMI-DADE. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
